The Act provides a framework for impartially reconciling the rights and obligations of both the person who wishes to do the work and the neighbour who could be affected by it. In the event of a disagreement there is a set procedure for the resolution of the dispute.
If agreement cannot be reached, the Act requires the building owner and the neighbour to appoint Surveyors, who must be impartial and draw up an agreement which is fair to both parties – this being known as an Award.
Anyone not directly involved in the work can be appointed, but it is essential that the surveyor has a good knowledge of party wall law and is skilled in the implementation of the procedures of the Act.
As a Chartered Surveyor I have had a considerable experience of party walls since the Act came into effect, and I have been appointed as party wall surveyor to both owners and neighbours in a wide variety of circumstances.
